If you need immediate protection from threats, violence, or harassment, it is likely that you need a CPO. Your eligibility for what type of CPO you need depends on the nature of your individual case. There are four different kinds of Civil Protection Orders:
- Domestic Violence Civil Protection Order (DVCPO), for victims of abuse by household members, family members, or individuals you share children with
- Civil Stalking or Sexually Oriented Offense Protection Order
- Dating Violence Protection Order
- Juvenile Protection Order, for cases when the offender is under 18 years old
The Hearing Process
It’s always best to talk to a lawyer about your case to get a clear picture of what type of CPO to file if unsure. CPO filing does require there to be a hearing, where you should be represented by an attorney.
A full hearing is necessary before a CPO can be issued. You must present your evidence and testimony to the court, before the judge can decide whether to issue the final order, which can last up to 5 years.
